Letters to the Editor - Downtown Noise

I am a long time/47 year resident of Loveland living on Riverside Drive. Until recently I enjoyed a quiet life on the Little Miami. In recent years that has changed due to excessive noise/music coming from downtown Loveland.


There is both common law and statutory law that exists and is actionable for protecting my right to “the peaceful and quiet use and enjoyment of my property and home.


My first noise complaint to the Loveland police department was 12/28/24 @ 9:10 pm. To date, I have called the Loveland police department over 60 times filing nuisance noise complaints for excessive and unnecessary noise coming from downtown. The Loveland police department has yet to issue any warnings or citations to any establishment for violating existing local, county, state, and federal statues and regulations.  By definition, the Loveland police department is”derelict” in their duties.  Consequentially, the Loveland police department needs to be held accountable for their lack of performance and serious breach of professional and legal obligations. The city council and city manager need to address this immediately and with the consequences it deserves. Anything less would be injudicious.


This nuisance noise from downtown Loveland is a result of a permit, 509.08(4)(c), that grants approval and allows “sound amplifying musical devices in connection with outdoor entertainment.”  Permit 509.08(4)(c) is a conditional permit as specified by the “Special Events Policy“ that requires the holder to comply with local, county, state, and federal laws and regulations. The “Special Events Policy” contains a specific clause regarding “Noise Violations.”  Again, has yet to be enforced.


The obvious question is: WHY IS THE EXCESSIVE AND UNNECESSARY NUISANCE NOISE ORIGINATING FROM DOWNTOWN BARS BLATANTLY BEING SIDE STEPPED AND NOT BEING ENFORCED?


My above stated comments are specifically directed at the mayor, the city manager, and the police chief.  All of whom should be held publicly accountable.

Hi David,


I sympathize with your circumstance and imagine that you are not the only one having to deal with the noise issue. Fortunately, I don't have to deal with it as I live outside of the 'blast radius' you have described...as I suspect the Mayor and other Council Members do also.


Whether I agree with you or not, there are really two issues in-play here:


1) Enforcement of existing ordinance - Responsibility of City Manager (who answers to full Council)


and


2) Accessibility of City Leadership (larger community-impacting)


The Ordinance I believe you are referencing is actually 509.08(c)(4)...(simple transposition of parts), where part 'c' lists the exemptions:


"Any other noise resulting from activities of a temporary duration permitted by…
